How pre-settlement funding works

A pending claim can create a difficult mismatch: expenses continue while the case takes time to resolve. Pre-settlement funding is one option some plaintiffs consider during that period. Before pursuing it, understand how a proposed advance would relate to a future recovery.

Begin with the case, not a promised amount

A funding review may involve the nature of the claim, the available documentation, and information from counsel. An inquiry is the beginning of that review; it should not be treated as approval or a guarantee of a particular amount.

Ask which information is needed and how it should be shared. Avoid sending medical records, identification documents, or confidential legal material through a general website form.

Understand the complete obligation

The amount received is only one part of the decision. Request the complete agreement and a clear explanation of charges, how the amount payable can change with time, and the circumstances in which repayment is required.

Ask for written examples covering different resolution dates. An example that assumes a quick settlement may not help you understand a case that lasts substantially longer.

Discuss the decision with your attorney

Your attorney can help you consider how a proposed arrangement relates to the claim and the expected distribution of any recovery. Ask what attorney involvement the funding provider requires and whether there are unresolved questions in the agreement.

Compare the proposal with other options available to you. The purpose of the conversation is to understand the tradeoffs before signing, including what happens if the claim recovers less than expected or does not recover money.
